Franchisee group refiles suit against Quiznos

MILWAUKEE A group of Quiznos franchisees has refiled a lawsuit against their Denver-based franchisor, this time in a Wisconsin court, that alleges the company engaged in deceptive trade practices. The suit was thrown out of a federal court last fall.

Although federal Judge William Griesbach dismissed the lawsuit in November, he stated his encouragement within the decision that the plaintiffs seek redress under Wisconsin laws.

The suit, refiled in the Milwaukee County Circuit Court, accuses the 5,000-plus-unit Quiznos chain of breaching promises about the cost of operating a Quiznos sandwich shop. It also alleges that the company failed to act in good faith by trying to build the brand’s value at the expense of franchise owners.

The Wisconsin suit is one of three still pending against Quiznos. Two are in Denver and one is in Illinois.

Aspokeswoman for Quiznos declined to comment on the case because the company has not yet reviewed the complaint. However, she did say that as the first case was dismissed, Quiznos expects the same outcome of the second suit.
