In-N-Out settles trademark suit over logo

IRVINE Calif. In-N-Out Burger has settled a trademark infringement lawsuit filed against Nicky’s In-N-Out Inc. of Chicago, officials from the iconic burger brand said Wednesday.

 

Arnold Wensinger, In-N-Out Burger's vice president and general counsel, said the terms of the settlement were confidential and that he could not comment, except to say the matter was resolved.

 

 

 

The lawsuit was reportedly filed in June. In-N-Out took issue with Nicky’s use of an angled yellow arrow in the restaurant logo, which resembled the logo used by the Irvine, Calif.-based quick-service chain.

 

 

 

Wensinger said another trademark infringement case filed in 2007 against the Utah restaurant Chadder’s is also settled and under similar confidentiality provisions. In that case, In-N-Out objected to Chadder’s use of its well-known burger names, such as the “Double, Double.”

 

 

 

In-N-Out Burger operates more than 230 units, primarily in the western United States.
